Terms and Conditions of the Trading Platform

Welcome to the official website of JSC "Sushi Mania" (hereinafter referred to as the "Company", "we", or "Sushi 24", "Sushi Wok").

1. Terms and Definitions

  • Offer – This document, specifically the offer of the trading platform.
  • Trading Platform (Website/Application) – A service that provides the user with access to information about products, and the ability to select and purchase products.
  • User – Any legally capable physical person over the age of 18 who uses the trading platform to order goods.
  • Personal Account – A personal section of the trading platform, inaccessible to third parties, which allows the user to place orders.
  • Aggregator Company – A third party (e.g., Glovo, Wolt, Bolt, etc.) that owns an e-commerce platform (mobile application and/or website) and provides the physical delivery of products to the user.
  • Chargeback – The procedure of returning (withdrawing) funds through a bank.

2. Registration and Authorization on the Platform

  • To place an order on the trading platform, the user can register or order as a guest (without registration).
  • Registration and authorization on the trading platform are carried out via a phone number and a one-time code sent by the Company to the user as an SMS or push notification.
  • It is impossible to create two personal accounts using one phone number.
  • In the case of registration, you are responsible for maintaining the confidentiality of your password and account. Any action performed through your account is considered performed by you.
  • Transferring access rights to the personal account to a third party is prohibited. The user is responsible for any negative consequences, including material damage.
  • In case of loss of the phone number used for registration, restoration of access to the personal account is impossible.
  • Our services are available to legally capable persons over the age of 18. Persons under 18 can only place an order with the involvement and consent of a parent or legal representative.

3. User Data Management

  • User data submitted must be reliable, up-to-date, and must not contradict legislation.
  • Notification management functionality (service push notifications and marketing SMS) is available to the user in the personal account.
  • The user has the functional capability to independently delete bank card data in the personal account.
  • Bank card data is deleted no later than 10 (ten) working days after the request, provided the user has no obligations to the Company and there is no suspicion of fraudulent activity.
  • The function to delete the personal account is available, though it may be restricted if the user has an active delivery order or outstanding debt.

4. Placing Orders and Information

  • Product photos on the website may be for illustrative purposes. The actual visual appearance (presentation) of the product may differ insignificantly from the photo, which does not constitute a product defect.
  • Placing an order is considered an offer from you to the Company. The agreement is considered concluded once the Company confirms receipt of the order (via SMS, email, or website notification).
  • To facilitate the order, the user may receive push notifications or phone calls to the provided number.
  • The Company reserves the right to cancel an order if an ingredient is out of stock or if an incorrect price was indicated due to a system error (a full refund will be issued).

5. Prices, Fees, and Payment Methods

  • Prices on the website are given in the national currency (GEL) and include Value Added Tax (VAT).
  • The cost of the delivery service is individual, calculated according to the address/zone, and added to the total order sum based on the rules of the aggregator company (Glovo, Wolt, Bolt, etc.).
  • Settlement is carried out in non-cash form: Visa, MasterCard, American Express (AMEX) cards, or electronic wallet (UniPay). Cash payment is allowed only upon delivery to the courier (if this option is active on the website).
  • Online payments are processed through the secure system of a partner bank/payment provider. We do not store your full card details.
  • If, for any reason, funds cannot be deducted after placing an order, the Company is authorized to use any bank card information provided by the user on the platform to deduct the amount without prior notice.
  • The Company will not impose any additional commission on the user during the transaction.

6. Delivery Terms and Product Receipt

  • Delivery is carried out only within zones predefined by the Company or the aggregator company.
  • Delivery times are approximate. Delays may be caused by traffic, weather, or high order volume and are not the responsibility of the Company if delivery is handled by an aggregator company.
  • Ownership rights and the risk of damage to the ordered goods transfer to the user from the moment of actual handover.
  • If the courier cannot reach you at the specified number or address, they will wait for no more than 10 minutes. After this period, the order is cancelled, and due to the perishable nature of the product, online payments are non-refundable.

7. Cancellation, Defects, and Chargeback Policy

  • Exception to 14-day return: According to legislation, the 14-day unconditional right of return does not apply to perishable products (prepared food). Returns of prepared food due to a change of mind are not permitted.
  • Cancellation before start: The user has the right to cancel an order only before the preparation/delivery of goods begins, or within 60 minutes of placing the order (whichever comes first).
  • Defective order: You are obliged to check the contents of the order immediately upon receipt from the courier. If you find that:
  • The received product does not match your order;
  • The product is clearly damaged or of poor quality;
  • A product is missing from the order.

  • Chargeback: When a user initiates a forced refund (Chargeback) through the payment system/bank, the provider blocks the relevant amount. The Company is authorized to present delivery confirmation documentation, which it stores for 5 years, to confirm service provision. If the chargeback is requested without grounds and is proven so, the amount and associated costs will be deducted from the user's account.
  • Refunds: When applicable, funds will be returned to the user within fourteen (14) days from the request in the personal account.

8. Health Safety and Allergies

  • Company products contain potential allergens such as: fish, seafood, soy, gluten, sesame seeds, and dairy products.
  • The user is obliged to familiarize themselves with the ingredients before ordering and, in case of intolerance, leave an appropriate comment or contact us.
  • The Company waives responsibility for any allergic reaction or health deterioration if the user did not notify us of the allergy in advance or ignored the product composition.

9. User Feedback and Reviews

  • Only registered users who have received an order or refused it upon receipt can leave a review.
  • A user can leave only one review at a time.
  • It is strictly prohibited to publish reviews containing: personal/confidential data of individuals (including photos where faces are visible); profanity or offensive language; links to other websites.
  • The Company reserves the right to delete reviews that violate the rules at any time without prior notice or explanation.
  • By publishing a review, the user voluntarily makes their name and text public and agrees that the Company may use this material for advertising purposes without royalty payments.

10. User Guarantees and Account Blocking

  • The user guarantees that the specified bank card belongs to them or they have the legal right to use it.
  • The user is prohibited from using automated algorithms (bots, scripts) to collect information from the website.
  • In case of rule violations, fraudulent actions, or repeated order cancellations, the Company has the right to block the user’s personal account.

11. Intellectual Property

  • The design, logos, texts, trademarks, and software code on the website are the intellectual property of the Company. Copying, distribution, or modification for commercial purposes or any advantage without prior written consent is prohibited.

12. Limitation of Liability (Force Majeure)

  • Parties are exempt from failure to fulfill obligations in the event of Force Majeure: natural disasters, epidemics, hostilities, strikes, or global server/internet provider outages.
  • The Company is not responsible for communication service failures resulting in loss of information.

13. Changes and Dispute Resolution

  • The Company reserves the right to unilaterally change these terms at any time. The updated version takes effect immediately upon publication on the website.
  • These rules are governed and interpreted in accordance with the current legislation of Georgia.
  • Any dispute or disagreement shall first be settled through negotiation; if an agreement is not reached, it shall be resolved by the common courts of Georgia.
